Terms of Use

These Terms of Use (“Terms”) govern access to and use of the Saúde d'Agente application (“Application”), provided by 2BLP Futuro Ltda., registered in Brazil under CNPJ 57.899.732/0001-82 (“2BLP”).

By accepting and/or using the Application, the User confirms that they have read, understood, and agreed to these Terms and the Saúde d'Agente Privacy Policy. Users who do not agree must not use the Application. 2BLP may record the date, time, and version accepted as evidence.

• Application: Saúde d'Agente, made available through Google Play and the Apple App Store.
• User: a Community Health Worker who uses the Application to follow their own health.
• MediRec: the health platform operated by 2BLP in the public health network, of which the Application forms part.
• SUS Data: health and identification information originating from Brazil's Unified Health System and displayed in the Application.
• User-entered Data: information voluntarily entered by the User, such as chronic conditions and allergies.

The Application lets Community Health Workers follow their own health independently and away from the workplace, under a shared-care model. It brings together public-network information and information the User chooses to enter.

It is a health-information follow-up and organization tool, not a medical service and not a source of diagnosis, prescription, or treatment.

The Application is provided free of charge. The User remains responsible for any data or connectivity costs.

The Application is intended for adults working as Community Health Workers in Rio de Janeiro's public health network, including interns in that role. Access is personal and non-transferable. Users are responsible for keeping their credentials confidential and must report unauthorized use immediately.

Access depends on maintaining Community Health Worker status in the municipal network. Losing that status automatically suspends access, including after a change to another role at the same facility. A transfer between municipal facilities does not affect access if the User remains a Community Health Worker.

5.1. SUS Data is the responsibility of public health bodies and is displayed in read-only mode. The Application is not the official source and does not allow direct modification or deletion.

5.2. Correction or deletion requests follow the Privacy Policy and may be sent to the relevant health unit or 2BLP's Data Protection Officer.

5.3. User-entered Data may be edited or deleted by the User.

5.4. 2BLP seeks to display source information faithfully but cannot guarantee that source-system discrepancies, synchronization delays, or omissions will not occur.

6.1. The Application does not replace consultation, evaluation, diagnosis, or treatment by health professionals.

6.3. Nothing displayed should be interpreted as an individualized clinical recommendation.

The Application is a software tool intended for the care of the User's own health under a shared-care model. 2BLP is neither the User's employer nor their health care provider, and use of the Application does not create, alter, or replace any employment, public-service, or health care relationship. Health care is provided by the health network to which the User is connected; 2BLP's role is exclusively to provide and maintain the Application.

The Application is intended exclusively for the User to follow their own health circumstances. Its use is not a job duty, assignment, or employment obligation and must not be required as a work activity.

The User also acknowledges that:

• User-entered Data (such as chronic conditions and allergies) is not made available to the employer or the health care team in the Application's format, as described in the Privacy Policy; and
• any use of the User's health information for discrimination, recruitment, performance evaluation, or any employment-related decision is prohibited by Brazilian law, particularly Law 9,029/1995.

Users must act lawfully and in good faith. They must not:

• access or attempt to access another person's data;
• bypass, test, or compromise security, authentication, or access controls;
• reverse engineer, decompile, or extract source code except where expressly permitted by law;
• enter false, unlawful, or third-party information;
• use the Application for a purpose outside these Terms.

Data processing complies with Brazil's General Data Protection Law (Law 13,709/2018) and is described in the Saúde d'Agente Privacy Policy. Consent for sensitive data entered by the User is specific and collected separately when the information is entered, and may be withdrawn at any time.

The Application, brand, visual identity, interfaces, text, structure, and software belong to 2BLP or its licensors. These Terms grant a personal, limited, non-exclusive, non-transferable, and revocable license solely for the purposes described here. No intellectual-property ownership is transferred to the User.

2BLP may update, modify, suspend, or discontinue features in whole or in part. It does not guarantee uninterrupted or error-free availability; maintenance, updates, or circumstances outside its control may cause downtime.

12.1. The User may stop using the Application at any time by uninstalling it and/or requesting account termination.

12.2. 2BLP may suspend or terminate access following a breach, misuse, or an order from a competent authority.

12.3. Upon termination, User-entered Data is deleted under the Privacy Policy. SUS Data is unaffected.

12.4. Following suspension due to loss of Community Health Worker status, User-entered Data is retained for 60 days, during which export or deletion may be requested. If eligibility is restored in that period, access is reactivated. Otherwise, the account is closed and User-entered Data is deleted.

To the fullest extent allowed by law, without limiting mandatory consumer protections, 2BLP is not responsible for:

• discrepancies, delays, unavailability, or omissions in SUS Data caused by source systems;
• decisions based exclusively on information displayed in the Application, subject to Section 6;
• misuse of the Application or credentials by the User.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded.

These Terms are between the User and 2BLP, not Apple Inc. or Google LLC (the “Stores”). 2BLP is responsible for the Application and its content.

For the App Store:

• Maintenance and support: 2BLP is solely responsible; Apple has no obligation to provide them.
• Warranty: if the Application fails to conform to an applicable warranty, the User may notify Apple, which may refund any purchase price; other claims remain 2BLP's responsibility.
• Claims: 2BLP is responsible for claims involving product liability, legal compliance, consumer protection, and intellectual-property infringement.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
• Compliance: the User represents that they are not located in an embargoed country or listed as a prohibited party and agrees to comply with Store terms.

For Google Play, Google Play's terms also apply. Google is not a party to these Terms and is not responsible for the Application.

2BLP may change these Terms. The current version will always be available in the Application and at saude-dagente-website.vercel.app. Material changes may be communicated, and continued use after an update constitutes agreement.

These Terms are governed by the laws of the Federative Republic of Brazil. Courts in the User's place of residence have jurisdiction, without limiting mandatory protections under Brazil's Consumer Defense Code.
